Edited by Dr. Ramona\nCoelho, Dr. K. Sonu Gaind and law professor Trudo Lemmens.<\/span><\/p>\n\n

\u201cFrom a cross-disciplinary\nperspective, including contributions from authors with lived experience,\nIndigenous perspectives, and expertise in medicine, mental health, disability,\nlaw, and ethics, Unravelling MAiD in Canada<\/i> challenges readers with the\nethical, medical, legal, societal, and disability justice rights concerns that\nhave arisen in regard to this hotly debated irreversible practice.\u201d<\/span><\/p>\n\n

As the federal election approaches,\nthe Coll\u00e8ge des M\u00e9decins du Qu\u00e9bec<\/b>\ncontinues to lobby for MAiD expansion, regardless of their mandate to protect\nthe public. La Presse published <\/span>a letter from president Dr. Mauril\nGaudreault<\/span><\/a><\/span> last week, pressing the candidates to commit to MAiD by\nadvance request.<\/span><\/p>\n\n

The Alliance\u2019s response to La Presse\nis copied below. It has not been published.<\/span><\/p>\n\n

**<\/span><\/p>\n\n

In March, <\/span>the <\/span>United Nations Committee on the Rights of Persons with\nDisabilities<\/span><\/b> recommended that Canada repeal\nTrack 2 MAiD<\/span><\/a><\/span>\n(for persons whose death is not reasonably foreseeable). The Committee\nstated that the current law \u201cis based on negative, ableist perceptions of the\nquality and value of the life of persons with disabilities, including that\n\u2018suffering\u2019 is intrinsic to disability rather than the fact that inequality and\ndiscrimination cause and compound \u2018suffering\u2019 for persons with\ndisabilities.\u201d  <\/span><\/p>\n\n

The only political party to respond to the report was the\nGreen Party, which supported the UN recommendation.<\/span><\/p>\n\n

**<\/span><\/span><\/p>\n\n

Indeed, the many known abuses of the\nMAiD law are very far from the discourse of most of the political parties. In\nthe attachment<\/a>, provided by <\/span>Living with Dignity<\/span><\/b><\/a><\/span>, you can read what each\nparty has or has not said about this burning issue.<\/span><\/p>\n\n

There is much to consider as we\nreflect on Monday\u2019s vote.<\/span><\/p>\n\n

Response to: <\/span>The next government must permit\nadvance requests<\/span><\/b><\/a><\/span><\/span><\/p>\n\n

Once again, the Coll\u00e8ge des\nM\u00e9decins du Qu\u00e9bec<\/i><\/b> (CMQ) is engaging in political activism, which is\nalien to its mandate to ensure quality medical care and protect the public. We\nphysicians are obliged to pay dues to the CMQ to maintain our license to\npractise medicine, and the funds are used to promote extreme political\npositions. <\/span><\/p>\n\n

The CMQ is pressing the federal\npoliticians to authorize medical aid in dying (MAiD) by advance request\n(permitted by Quebec law but contrary to the Criminal Code), and for mental\nillness (an option that was firmly rejected by the Quebec government).<\/span><\/p>\n\n

It is well known across Canada that\nmany people request and receive MAiD because of loneliness, isolation, poverty\nand a lack of access to medical care, social supports and decent housing. There\nare anecdotes indicating the same tendency in Quebec, but little specific\ninformation because no one is looking for it, as Ontario recently did, leading\nto <\/span>shocking revelations<\/span><\/a><\/span>.<\/span><\/p>\n\n

The only data available to Quebec\u2019s Commission\nsur les soins de fin de vie<\/i><\/b> (CSFV) is self-reported by MAiD providers,\na questionable way of monitoring a practice that is a criminal offence if the\nlaw is not respected. In spite of this limitation it <\/span>raised the alarm<\/span><\/a><\/span> in 2023 about the rising\nnumber of cases that did not conform to the law or were borderline. The\nCommission reminded doctors that the second medical opinion is not a formality,\nthat doctor-shopping to find a favourable opinion is not acceptable, and that\nadvanced age is not a serious and incurable disease justifying MAiD. <\/span>The CMQ complained<\/span><\/a><\/span>, in response, that they\nshould not frighten doctors away from performing MAiD. What happened to\nprotecting the public? <\/span><\/p>\n\n

People with dementia are among the\nmost vulnerable of our citizens and need to be protected. When they  <\/span>suffer, it is almost universally related to\ntheir living conditions and the attitudes of those around them, not to their\nillness as such. <\/span><\/p>\n\n

MAiD by advance request means that a\nlethal injection is given to someone who cannot consent to or refuse it. What\nis dignified about that? Even some <\/span>well-known MAiD providers<\/span><\/a><\/span> are not willing to administer\nit in that situation, citing an expected need to restrain or sedate the\npatient, to prevent him or her from pulling out the IV. <\/span><\/p>\n\n

MAiD by advance request is popular in\nopinion polls because of fear. Fear of suffering, of ageing, of being abandoned\nby one\u2019s family, of being mistreated in a hospital or a CHSLD because of\nageism, ableism or insufficient resources. Instead of seeking solutions to\nthese legitimate fears, the CMQ agitates for a short-cut to death. What\nhappened to protecting the public? <\/span><\/p>\n\n

Be it known that the CMQ in no way\nrepresents the views of all doctors.<\/span><\/p>\n\n
